Hiniling ng mga state prosecutor sa Sandiganbayan Second Division na suspendihin si Marinduque Governor Carmencita Reyes na nahaharap sa kasong katiwalian.
“Wherefore, premises considered, it is most respectfully prayed of this Honorable Court that after due notice and hearing, an Order be issued suspending accused Carmencita O. Reyes from her office pending trial,” nakasaad sa mosyon ng prosekusyon na isinumite sa Second Division.

Dahil nahaharap sa graft case si Reyes, sinabi ng prosekusyon na dapat suspendihin ang gobernadora tulad ng nakasaad sa probisyon ng Republic Act 3019 o Anti-Graft and Corrupt Practices Act.
“Any incumbent public officer against whom any criminal prosecution under a valid information under this Act or under Title 7, Book II of the Revised Penal Code or for any offense involving fraud upon government or public funds or property, whether as simple or as complex offense in whatever state of execution and mode or participation, is pending in court, shall be suspended from office,” tinukoy ng prosekusyon na nakasaad sa RA 3019.
Bukod sa graft case, nahaharap din si Reyes ng kasong technical malversation sa Second Division.
Ito ay may kaugnayan sa umano’y maanomalyang pagbili ng mga shredding machine, hammer mill/ shifter, pelletizer at tornado brush chipper mula sa LCV Design and Fabrication Corporation noong 2004.
Sinabi ng Office of the Ombudsman na naganap ang transaksiyon nang walang isinagawang bidding.
Bukod dito, ang ipinangbayad umano sa mga farming equipment ay unang inilaan sa pagbili ng abono dahil ito ay kinuha sa Farm Input Fund ng Ginintuang Masaganang Ani Program ng Department of Agriculture.
